Notice To Users: Please Read This Agreement Carefully.

iBizard.com, Inc. has developed an online computer software program that provides services to users that includes, but is not limited to customer management, retention and marketing. This service is available to you through our software, at www.iBizard.com. By using all or any portion of the service, or by creating an account, you represent that you accept all terms and conditions contained in this agreement. You agree that this agreement is enforceable like any written negotiated agreement signed by you and you agree to be legally bound and to abide by this agreement just as if you had signed this agreement.

User Accounts

• You are responsible for maintaining the security of your account and password and are fully responsible for all activities that occur under your account.
• You may only have one account per email address.
• You may not use our service for any illegal or unauthorized purpose. Examples include: posting or disseminating illegal material (such as child pornography or obscene material). You must not violate any laws in your jurisdiction (including but not limited to copyright laws).
• You agree to immediately notify iBizard of any unauthorized use of your password or account or any other security breach at abuse@iBizard.com.

Anti SPAM Policy

We have a zero tolerance SPAM policy. Any customer found to be using iBizard for SPAM will have their account subject to immediate termination.

iBizard may only be used in connection with mailing lists for which recipients have voluntarily registered. Sending an email to an address you obtained without consent is a violation of iBizard´s Terms and Conditions. You may only send emails to customers that have willingly signed up to receive your mailings. If iBizard receives complaints about your customer list, your account is subject to immediate termination. You may not send mail under any company or organization name other than your own.

You are responsible for the content of your messages. We do not assume any responsibility or liability for messages or other content that is created by our users. You may not send, post, or distribute defamatory, obscene, or otherwise unlawful messages, material or information. Upon request we will cooperate with legal authorities in releasing names and IP addresses of users who are involved in SPAM or other illegal activities.

iBizard Software and Services

The iBizard software is owned by iBizard.com Inc. You may use the iBizard software as available through our website when you create an account. iBizard reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the services offered, with or without notice. You agree that iBizard shall not be liable for any modification, suspension or discontinuance of any service offered.

You have the option of utilizing our Free services upon opening an account with us. You can upgrade to any of the paid services at any time. When upgrading to a paid service, you will be billed for your first month immediately upon upgrading. Paid services are billed in advance on a monthly basis. If, at any time, you choose to downgrade or eliminate a service, that billing change will become effective with the next billing cycle. There will be no refunds for partial months of service. For any changes in plan level, the credit card that you provided will automatically be charged the new rate on your next billing cycle.

Canceling Your Account

You can cancel your iBizard account at any time by clicking on the Update Account link. The Account screen provides a simple link. If you cancel any of our paid services before the end of your current paid up month, your cancellation will take effect immediately and you will not be charged again.

General Conditions

iBizard provides space and software for, but not limited to, customer management, retention, and marketing but we are not responsible for any deletion, alteration, or loss of information or results due to network or system outages, file corruption, accidental deletion, incompatibilities or any other reasons. We make no guarantees as to server reliability, speed, or consistency, and cannot be held liable for such.

We make no guarantee of the accuracy, correctness, or completeness of any information on our web pages, and are not responsible for any errors or omissions arising from the use of such information; any failures, delays, or interruptions in the delivery of any content or services contained on our servers; or losses or damages arising from the use of the content or services provided by us. You agree to indemnify us against any and all claims and expenses, including attorneys' fees, arising from the use of this service.

We reserve the right to amend or change these guidelines at any time, without notice.

Termination

Any violation of the Terms of Use constitutes grounds for immediate termination of a user account without notice or refund. Upon such termination, we shall have no liability or responsibility to you or any third-party.
